These Terms of Use ("Terms") are a legally binding agreement between you and Delisa Cares ("we," "us," or "our"), a sole proprietorship based in Washington State, USA. They govern your access to and use of delisacares.com and any products or services we offer. By accessing the site or purchasing any product, you confirm that you have read, understood, and agree to be bound by these Terms.

1. About Delisa Cares

Delisa Cares is an independent practice offering pet care services, adoption transition support, educational guides, and instructional design consulting. It is operated by a sole proprietor in Washington State, USA. Products include digital downloads (such as field guides, toolkits, and prompt packs) and consulting services. References to "the site" refer to delisacares.com and any associated pages or services.

2. Eligibility

By using this site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

3. Digital Products — License and Delivery

Delivery

Upon completing a purchase, you will receive access to the purchased digital product via a download link on the post-purchase confirmation page. You are responsible for downloading and saving your files promptly.

License grant

Upon purchase, we grant you a limited, personal, non-exclusive, non-transferable license to use the purchased digital product for your own professional work. This license does not include the right to resell, redistribute, publish publicly, use to create a competing product, or remove copyright notices.

Team or organizational use

The standard license covers a single user. For team or organizational licensing, contact us at delisa@delisacares.com.

4. Pet Care Services

Pet care services (dog walking, drop-in visits, enrichment visits, pet taxi, and Safe Landing adoption support) are provided as described on the site. Service details, scheduling, and pricing are confirmed before services begin. Payment is expected at the time of service or as agreed upon in advance.

5. Consulting Services

Consulting services (Training Audits, Stakeholder Pitch Support, Training Design, Ongoing Advisory) are provided as described on the For Organizations page. Scope, deliverables, and timelines are agreed upon before work begins. Consulting fees are non-refundable once work has commenced unless otherwise agreed in writing.

6. Refund Policy

All sales of digital products are final. Because digital products are delivered immediately upon purchase and cannot be "returned," we do not offer refunds as a matter of standard policy. If you experience a verified technical failure that prevents you from accessing your purchased product, contact us within 7 days of purchase.

7. Intellectual Property

All content on delisacares.com — including text, design, graphics, frameworks, prompt structures, methodologies, and branding — is the intellectual property of Delisa Cares and is protected by applicable copyright, trademark, and intellectual property laws.

8. Use of AI Tools

Some products are designed to be used with third-party AI tools, including ChatGPT (OpenAI) and Claude (Anthropic). Your use of those tools is subject to their respective terms of service. We make no warranties regarding the quality, accuracy, or suitability of outputs generated by AI tools.

9. Acceptable Use

By using this site, you agree not to violate any applicable law, infringe on intellectual property rights, resell or redistribute purchased products, use the site to transmit harmful code, attempt unauthorized access, or impersonate Delisa Cares or its representatives.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, all products, the site, and all content and services are provided "as is" and "as available" without warranties of any kind, express or implied.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Delisa Cares shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total cumulative liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or $50 USD, whichever is greater.

12. Dispute Resolution

Before initiating any formal legal proceedings, you agree to contact us and give us 30 days to attempt to resolve the dispute informally. If informal resolution fails, disputes shall be resolved by binding individual arbitration in Washington State.

13. Governing Law

These Terms are governed by the laws of the State of Washington, United States.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top.
